Note: These T&Cs apply to general website use and preliminary engagement. Specific professional services (such as cyber security, cloud migration, or data center projects) are governed by a separate Master Services Agreement (MSA) or Service Agreement between you and Infomix Engineering Services. In the event of any conflict, the MSA or Service Agreement will prevail.

2. Services and Business Focus

Infomix Engineering Services provides professional engineering and technology consulting services, primarily in the areas of:

  • Cyber Security
  • Data Centre Management
  • Cloud Strategy and Migration
  • IT Infrastructure and Mining Technology Solutions

Our services are provided on a Business-to-Business (B2B) basis and are designed for corporate and enterprise clients.

3. Website Use and Intellectual Property (IP)

A. Website Content

All content on this website, including text, graphics, logos, white papers, and technical information, is the property of Infomix Engineering Services or its licensors and is protected by Australian and international copyright and intellectual property laws.

B. Limited License

We grant you a limited, non-exclusive, and non-transferable license to access and use our website solely for the purpose of learning about our services and contacting us. You must not copy, modify, reproduce, distribute, sell, publish, or exploit any content without our prior written consent.

C. Client Project IP

Intellectual Property created by Infomix Engineering Services during a paid client engagement (such as custom code, architecture designs or security documentation)  is governed by the  IP clauses outlined in your signed MSA or Service Agreement.

4. Limitation of Liability and Australian Consumer Law

A. No Guarantees

While we make every effort to ensure the accuracy and reliability of information on this website, all content is provided on an “as is” and “as available” basis. We do not guarantee that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

B. Exclusion of Liability

To the maximum extent permitted by Australian law, Infomix Engineering Services and its directors, employees, and agents disclaim all liability for any loss, damage, or claims (including direct, indirect, or consequential losses) arising from your use of, or inability to use, this website.

C. Consumer Protections

If the Competition and Consumer Act 2010 (Cth) or any other law implies a condition, warranty, or guarantee that cannot be excluded, our liability is limited, at our discretion, to one or more of the following (at our option):

  1. The resupply of the services; or
  2. The payment of the cost of having the services resupplied.

5. Client Confidentiality

We understand that our engagement may involve access to sensitive business, technical, or security-related information.

Any information shared with us during a formal, paid engagement is treated as confidential and managed in accordance with the confidentiality and non-disclosure provisions in your MSA or Service Agreement. The handling of personal data is addressed in our Privacy Policy, available on our website.

6. Governing Law and Jurisdiction

These T&Cs are governed by the laws of Western Australia and the Commonwealth of Australia.

You irrevocably submit to the exclusive jurisdiction of the courts in Western Australia for determining any dispute concerning these T&Cs.

7. Changes to Terms

We reserve the right to revise or update these T&Cs at any time. Any changes will take effect immediately upon being  posted on this website. By continuing to use our website aftersuch updates, you agree to be bound by the revised T&Cs.
